Former Giant Lineman Oates Named In Lawsuit:

For the second time less than two years, two retired professional athletes have been named in a lawsuit over payment in regards to their development company.

Among the defendants named in the civil suit, filed Thursday in Superior Court in Morris County, are former New York Giants player Bart Oates of Morristown and former New Jersey Devils defenseman Kenneth Daneyko of Mendham. Hazlet resident J. Michael Gallager and his wife, Rebecca, as well as Oates’ wife, Michelle, are also named as defendants in the suit, which was filed by Kinnelon residents Mounir, Halina and Hany Badaan

Oates, Daneyko and Gallagher are all partners in Pro Re Developers Wildwood I, LLC, a real estate company based in Hazlet.

According to the complaint, in March 2006 the Badaans had invested $1 million in the company, with a guaranty signed by the defendants that they would be repaid in full, plus interest and legal fees, within three years.

But by the end of March 2009, the complaint alleges, the Badaans had not received the $1.331 million they were owed.

According to the complaint, Pro R.E. Developers had told the Badaans they had intended to acquire properties, but in the end never bought the properties or secured financing to buy them.
Oates and Daneyko could not be reached for comment. Attorney Arthur Grossman, who represents the Badaans in the suit, did not return calls for comment.

The lawsuit comes just 14 months after a Superior Court judge in Essex County issued arrest warrants for Oates, Daneyko and Gallagher for repeatedly failing to show up to depositions for another suit against Pro R.E. Developers. The depositions related to a judgement against the men for failing to pay back half of a $300,000 loan given in 2006 to finance interest in a luxury hotel project in Wildwood that had failed to move forward.

Oates, Daneyko and Gallagher later appeared in court and said their no-shows were the result of a misunderstanding and agreed to work out a payment schedule with the lender.

Oates was a center with the Giants and San Francisco 49ers, playing in three Super Bowls. Daneyko played defense for the Devils for his 20-year career before retiring.
